Jair Bolsonaro has been arrested after authorities determined he posed a definite escape threat while under home confinement.
The ex-president was sentenced of planning a government overthrow in the ninth month and sentenced more than over two decades in jail, but he was staying under house arrest pending legal challenges.
High Court Judge Alexandre de Moraes said the move to detain the 70-year-old politician was a preventative measure after "new facts" were revealed.
This encompassed seeking to disable his ankle monitor and a call for a supporters' gathering that could "allow for a potential flight.
Court Filing Details Escape Risks
In a document approving the custody, the magistrate said data from the unit overseeing his home detention suggested the ex-president's plan to remove the electronic ankle bracelet to secure accomplishment in his escape.
This, it said, would be assisted by the chaos caused by the protest called by his offspring.
His child, Flávio, who works as a senator, called for a gathering of his backers near his father's house to take place on Saturday night.
His son wrote on social media on the previous day: "Are you going to fight for your country, or watch it all from your mobile device there on your settee? I urge you to fight with us."
He said the vigil would be so followers could seek divine intervention for his health and for the reestablishment of democratic governance in our nation."
Diplomatic Refuge Fears
Part of the judge's ruling was the chance of Bolsonaro's move to embassies near the residence, considering that the investigations revealed a record of planning to ask for protection through a diplomatic representation", a statement said.
The court filing emphasizes that the American diplomatic mission in the national capital, the capital city, is positioned around 13km from his dwelling.
Global Responses
His judicial problems have drawn the ire of fellow conservative nationalist American leader Trump, prompting him to enact a 50% tariff on goods coming from Brazil.
Bolsonaro is being held in a Federal Police station in the capital and will have a detention review on Sunday.
Recent Legal Requests
It was only on the previous day that the ex-leader's attorneys asked the Top Court to permit him to complete his entire prison term under domestic detention, with electronic monitoring.
They also petitioned that he be allowed to leave his home for medical treatment, saying he demanded ongoing care for pulmonary infections and other ailments.
Details of Guilty Verdict
Bolsonaro was convicted of leading a conspiracy aimed at keeping him in power after he lost the presidential race to his political opponent, Luiz Inácio Lula da Silva.
High Court judges said that he had knowledge of a scheme which involved plans to assassinate the current president and his vice-presidential running mate, Geraldo Alckmin, and to imprison and murder Alexandre de Moraes - the top judicial official who has been presiding over Bolsonaro's trial.
The scheme was prevented because it didn't receive the endorsement of the armed forces officials. Lula was sworn in without problem on January 1st, 2023.
But a week later, on the eighth of January, thousands of his backers stormed and vandalised official structures in the national capital, Brasília.
The police took action and around approximately 1,500 persons were detained.
The judges found that the protesters had been incited by him whose scheme, they said, was for the country's army to step in, restore order and reinstate his authority.
At the moment, the legal team called the decades-long sentence "absurdly excessive.
He was also banned from campaigning for office until twenty-sixty - a decade minus two years after the end of his sentence.
The former president called the court case a political persecution and said it was aimed at blocking him competing in the 2026 presidential election.
